These terms apply to the public Healthigence website. A separate written agreement governs access to or use of any Healthigence software, clinical product, pilot, research project or paid service.
1. Acceptance of these terms
By accessing or using healthigence.com.au (the “Website”), you agree to these terms. If you do not agree, please do not use the Website. “Healthigence”, “we”, “us” and “our” refer to the Healthigence business operating this Website.
You must be at least 18 years old, or have the permission and supervision required by law, to use the Website.
2. General information—not medical advice
The Website provides general information about Healthigence and its products. It does not provide medical advice, diagnosis, treatment, emergency services or a clinician–patient relationship. Do not rely on Website content to make a healthcare decision. Seek advice from a qualified healthcare professional. In an emergency in Australia, call 000.
Product descriptions are summaries only. Features, performance, availability and regulatory status may change and may differ by customer, configuration and jurisdiction. References to AI outputs, alerts or decision support do not mean that a product replaces clinical judgement.
3. Acceptable use
You may use the Website lawfully for personal or legitimate business information purposes. You must not:
- interfere with the security, availability or operation of the Website;
- attempt unauthorised access, introduce malicious code, scrape at unreasonable volume or bypass access controls;
- use the Website to infringe rights, mislead others or engage in unlawful conduct;
- submit patient information, confidential clinical data or sensitive information through a general website form; or
- misrepresent any relationship with Healthigence.
We may restrict access where reasonably necessary to protect the Website, users or our rights.
4. Intellectual property
The Website, its design, text, graphics, software, trade marks and other content are owned by or licensed to Healthigence and protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive and non-transferable permission to view the Website and make a reasonable number of copies for internal, non-commercial reference.
You must not reproduce, modify, distribute, commercialise or create derivative works from Website content without written permission, except as allowed by law. Third-party marks remain the property of their owners.
5. Enquiries and submissions
You confirm that information you submit is accurate, that you have authority to provide it and that it does not infringe another person’s rights. Do not send confidential ideas or information unless a written confidentiality arrangement is already in place. We may use enquiry information to respond and manage our relationship in accordance with our Privacy Policy.
6. Third-party links
The Website may link to third-party websites, publications or services. Links are provided for convenience and do not necessarily indicate endorsement. We do not control third-party content, availability or privacy practices, and you use those services under their own terms.
7. Website availability and changes
We aim to keep Website information useful and current but do not promise uninterrupted access or that all content is complete, accurate or error-free. We may change, suspend or discontinue Website content or functionality at any time.
8. Consumer rights, warranties and liability
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, the Website is provided “as is” and “as available”. We exclude warranties that may lawfully be excluded. To the maximum extent permitted by law, Healthigence is not liable for indirect, consequential, special or incidental loss arising from use of, or inability to use, the Website. Where liability cannot be excluded but may lawfully be limited, our liability is limited to the extent permitted by law.
You are responsible for decisions made using general Website information and for maintaining appropriate device, network and security protections.
9. Privacy
Our Privacy Policy explains how we handle personal information in connection with the Website and other interactions.
10. Changes to these terms
We may update these terms by posting a revised version with a new “last updated” date. Changes apply from publication. Your continued use of the Website after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and courts entitled to hear appeals from them.
